NIGERIA INDUSTRIAL COURT PASSES JUDGEMENT AGAINST THE PRACTICE OF UNINFORMED TESTING OF EMPLOYEES AND TERMINATION ON GROUNDS OF HIV.

 
 
 
 

Mr. X. was employed as a Guard and posted to the U.S Embassy. His employment was terminated after he was made to undergo uninformed testing by his employees. He was referred to Lawyers Alert by the Network of Persons Living With HIV/AIDS in Nigeria (NEPWHAN) for Legal Assistance.


We approached the National Industrial Court seeking among other things; declaration that his termination was unlawful as a result of his health status, that his uninformed testing unlawful, and damages. In the course of trial, we also obtained an anonymity order to protect his confidentiality. Litigation was with the support of the Southern Africa Litigation Centre, Advocacy support by Enda Sante, while UNAIDS Nigeria provided in-country coordination and support.
