Rommy Mom Vs BSEMA, Matter struck out

The Suit between Rommy Mom and the Benue State Emergency Management Agency under the FOI Law for information on the expenditures of  the flood victims assistance sum was today struck out by Justice Ada Onum.

At the last hearing,  owing to the fact that Mr. Agbanjo Lawyer to  Rommy Mom was in the Federal High Court today,  Justiced Onum scheduled the matter to 12 Noon as against the usual  9:.00am to enable Rommy Mom and his lawyer appear.

Apparently the Judge did not reduce this in writing in his order of adjournment and today at 9:00am the suit was called and  struck out as Mr Mom and his lawyer were not in Court. When Mom and his lawyer subsequently showed up by 12 noon the matter had been struck out.

Litigant and Counsel met with the Judge in chambers to clarify the position.

A motion has already been filed to re-list the matter. The legal effect of such a motion is that the matter will continue from where it was struck out and not afresh.
