1. Case of Master X vs Command Secondary School, Suleja & Ors.
This case concerns the expulsion of Master X, a 12-year-old pupil of Command Secondary School, Suleja, due to his HIV-positive status, despite being on necessary treatment and care since inception. He was expelled from Command Secondary School, Suleja, after being embarrassed, humiliated, and escorted off the school premises with his mother. Lawyers Alert has initiated a court process seeking the enforcement of the Fundamental Human Rights of Master X as guaranteed under Sections 43 and 42 of the 1999 Constitution of the Federal Republic of Nigeria, and Articles 2, 4, 5, 16, and 19 of the African Charter on Human and Peoples' Rights (Ratification and Enforcement) Act Cap A9 LFN 2004.
The suit came up last on the 4th of June, 2024, for a hearing of our motion seeking leave of the court to use a pseudonym; however, due to the NLC's strike, the court did not sit. The new date slated for the hearing is the 22nd of July, 2024.
2. SUIT NO: FHC/ABJ/CS/642/2024 Between Incorporated Trustee of Lawyers Alert NG vs Abuja Environmental Protection Board & 3 ors
The case is about the harassment and human rights violation of women arrested on the streets of Abuja on the allegation of being Sex Workers by the FCT Ministerial Task Force, which includes the AEPB, the Nigeria Police, and the Nigerian Army. Lawyers Alert filed a suit at the Federal High Court seeking a declaration that the provisions of Section 6 of the Abuja Environmental Protection Board Act, 1997, or any other provision, do not give the AEPB the power to arrest women suspected of being Sex Workers or to harass women in Abuja, either by themselves or through other enforcement agencies. The suit came up for the first time on the 6th of June, 2024. The matter was mentioned and adjourned to the 2nd of July, 2024, for a hearing.
3. SUIT NO: FHC/ABJ/CS/642/2024 BETWEEN Incorporated Trustee of Lawyers Alert NG VS Minister of Health & 2 Ors
Lawyers Alert instituted a new SIL on Tuberculosis (TB) at the Federal High Court in Abuja, where we seek to use the instrumentalism of law to compel the Minister of Health to expand further the frontiers of People Affected by Tuberculosis (PATB) Rights and address issues of stigma and discrimination. The suit came up on the 5th of June, 2024, for the hearing of our application to amend; however, the court couldn't accommodate us because it was overwhelmed. The matter was subsequently adjourned to the 17th of June, 2024, but the Federal Government declared it a public holiday for the Salah Celebration. The new date is the 4th of July, 2024.
4. SUIT NO: CV/235/19 Between Incorporated Trustee of Lawyers Alert NG vs ARIK AIR.
The case centers on the abrupt cancellation of flights a few hours before takeoff without any reason given to the passengers. Lawyers Alert has filed a suit at the High Court of Abuja, FCT challenging the defendant’s actions in canceling flights without reasonable grounds and without providing adequate notice or an apology.
The case came up on the 5th of June, 2024, for a hearing. However, the defendant's counsel informed the court they had a motion to regularize their statement of defense. The application for regularization was granted, and the case was adjourned to the 3rd of July, 2024.
Makurdi – Headquarters
5. STATE VS AYINAORGA NGUTOWEN.
Lawyers Alert is watching proceedings to ensure compliance with processes and justice in a case involving the rape of a 14-year-old girl. The matter is before High Court 2 sitting in Makurdi, and it is at the stage of opening of defense for the defendant. The matter is adjourned to the 18th of September 2024.
6. STATE VA GODWIN MARK IORPUU.
Lawyers Alert is monitoring the proceedings involving the rape of a 6-year-old girl, the matter is before High Court 4 sitting in Makurdi, and it is at the stage of opening of defense for the defendant. The case comes up next on the 25th of July 2024.
7. COP VS IKOR EMMANUEL
The case concerns the rape of a 16-year-old girl, Lawyers Alert is monitoring proceedings on behalf of the complainant to ensure compliance with the processes and justice delivery. The matter is before Chief Magistrate 1 sitting in Makurdi, and it is at the stage of filing out information for the transfer of the case to the High Court. The matter is adjourned to the 17th of September 2024 for the filling of information to the High Court.
